1. Core Philosophy: Retail-First Mandate
• Retail Definition: A sale is only recognized if it is made to an end-consumer who is not an Independent Distributor (ID) of Keltix.
• Business Volume (BV): BV is a non-monetary value assigned to each product for the purpose of calculating Group Commissions and Rank Advancement.
• No Commission on Enrollment: In compliance with Section 83C of the Banking Act, no income is generated by the act of recruiting or enrolling new IDs.
• BV Exclusions: ID personal purchases do not generate BV. All BV must be tied to verified retail customer invoices to ensure a product-driven network.
• Right to Amend: Keltix reserves the right to amend, modify, or terminate any portion of these Policies & Procedures, the Compensation Plan, or product pricing at its sole and absolute discretion. Any such amendments shall be effective immediately upon publication on the official Keltix website or back-office portal. Continuous participation as an Independent Distributor (ID) following such amendments constitutes deemed acceptance of the new terms.
2. Group Commission Structure
• Group Sales: Commissions are calculated based on the balanced retail performance of Group 1 and Group 2.
• The “Step” Payout: 500 BV in Group 1 + 500 BV in Group 2 = LKR 15,000.
• Qualification Trigger: To earn Group Commissions, an ID must:
Achieve Retail Rank 2 (Minimum LKR 10,000 in retail sales to at least 2 unique customers in the previous month).
Activate their Tracking Center by introducing two direct referrals—one in Group 1 and one in Group 2.
• Weekly Payout Caps (by Rank):
• Silver: LKR 150,000 (10 steps)
• Gold: LKR 210,000 (14 steps)
• Platinum: LKR 300,000 (20 steps)
• Sapphire: LKR 405,000 (27 steps)
• Ruby: LKR 615,000 (41 steps)
• Emerald: LKR 870,000 (58 steps)
• Diamond: LKR 1,125,000 (75 steps)
3. Consumer Protection & Refund Policy
• 14-Day Cooling-Off Period: Customers have 14 days from the date of delivery to return unopened products for a full refund.
• Refund Processing: Keltix will process all valid refund requests within 30 days, as per Sri Lankan trade practice.
• Defective Goods: Products found to be defective or not matching the description will be replaced or refunded if reported within 3 months, in accordance with the Consumer Affairs Authority (CAA) Act.
4. Voluntary Resignation & Product Return (The Safety Net)
• Termination at Will: An ID may resign from Keltix at any time by providing written notice. No enrollment or exit fees apply.
• Inventory Safety Net: While IDs are not required to maintain inventory, Keltix provides a “Safe-Exit” guarantee to comply with regulatory standards. Upon resignation, if an ID possesses any unopened, marketable products purchased within the last 180 days, the Company will repurchase them at 90% of the original price.
• Account Deactivation: Upon resignation, the ID loses all rights to their Tracking Center and any future Group Commissions.
5. Professional Conduct & Ethics
• Branding & Tagline: All marketing must use the official logo and the tagline: “smarter better living”.
• Income Disclosure: IDs are strictly forbidden from guaranteeing specific income. All presentations must clarify that results depend on individual retail effort.
• Non-Compete: Active IDs may not promote competing direct selling or MLM companies in Sri Lanka to prevent conflicts of interest.
6. Legal & Regulatory Compliance
• Data Privacy: Under the Personal Data Protection Act No. 9 of 2022, IDs must safeguard customer data.
• Taxation: IDs are independent contractors and must provide their TIN (Taxpayer Identification Number) for commission processing.
• Jurisdiction: This agreement is governed by the laws of the Democratic Socialist Republic of Sri Lanka.
• Arbitration: Any unresolved disputes shall be settled via arbitration in Colombo under the Arbitration Act No. 11 of 1995.
